
Suspension of Indiana Driver’s License for Driving Without Insurance
Under Indiana law, all drivers are required to maintain auto insurance and carry proof of that insurance while operating a vehicle. The state mandates minimum liability coverage of 25/50/25, which means:
- $25,000 for bodily injury or death of one person,
- $50,000 for bodily injury or death of two or more people in a single accident, and
- $25,000 for property damage per accident.
Failing to maintain this insurance, or failing to provide proof of insurance when requested by law enforcement or the BMV, can lead to the suspension of your Indiana driver’s license for “failure to provide proof of financial responsibility.”
How to Reinstate Your License After a Suspension
1. Pay Your Fine
Start by paying the fine listed on the citation you received. You can do this online at www.mycase.in.gov.
2. If You Had Insurance at the Time of the Violation
If you were insured on the date you were cited, contact your insurance company and ask them to send a Certificate of Compliance (COC) to the Indiana Bureau of Motor Vehicles (BMV). This document proves you had valid insurance at the time of the traffic stop. Importantly, only your insurance company can submit this certificate directly to the BMV – you or your attorney cannot do so.
Once the BMV receives the Certificate of Compliance, your license suspension will be lifted. You will not have to pay a reinstatement fee to reinstate your license.
3. If You Did Not Have Insurance at the Time of the Violation
If you were uninsured, you will need to:
- Obtain valid auto insurance with SR-22 coverage.
- Ensure your insurer files proof of SR-22 coverage with the BMV. You cannot file this yourself, and neither can your attorney.
SR-22 is a additional coverage on top of your regular insurance that verifies financial responsibility and typically costs an additional $30 to $80 per month. Once the BMV receives proof of SR-22 coverage, your suspension will be “stayed,” meaning you can legally drive again.
You must maintain SR-22 coverage for 180 consecutive days. If your coverage lapses at any point during this period, your license will be suspended again, and the 180-day period will reset.
4. Reinstatement Fee
After successfully maintaining SR-22 coverage for 180 days, you will become eligible for full reinstatement of your driving privileges. Indiana law requires a $250 reinstatement fee for a first-time no-insurance suspension.
